PinSpot Privacy Policy

This Privacy Policy explains how 13TEN4 Ventures Inc., a Delaware corporation operating PinSpot (pinspot.ai) ("PinSpot," "we," "us," or "our"), collects, uses, shares, and protects information in connection with the PinSpot platform, website, messaging services, and related services (the "Service").

PinSpot is a business-facing service. Most of the information we handle is business information about venues (hours, events, specials, menus), which is intended to be public. This policy focuses on the personal information we collect from account holders, venue representatives, and site visitors.

1. Information We Collect

1.1 Information You Provide

• Account information — name, email address, password, and business/venue affiliation when you create an account or claim a venue.
• Free report requests — when you request a free AI visibility report, we collect your email address to deliver the report and, where you have given consent, to send you marketing communications about PinSpot. You can unsubscribe at any time.
• Venue content — business information you submit about your venue. This is business data intended for public distribution, but it may occasionally include personal information (e.g., a contact name in an event description).
• Phone number and messages — your mobile number when you verify a venue claim or opt in to messaging, and the content of SMS/WhatsApp messages you exchange with the PinSpot messaging agent.
• Payment information — processed by Stripe, our payment processor. We receive limited details (e.g., card brand, last four digits, billing status) but never store full card numbers.
• Communications — emails, support requests, and survey responses.

1.2 Information Collected Automatically

• Usage data — pages viewed, features used, dashboard activity, referring URLs.
• Device data — IP address, browser type, operating system, and device identifiers.
• Cookies and similar technologies — used for authentication, preferences, and analytics, including Google Analytics to understand site usage. You can control cookies through your browser settings; disabling them may limit functionality.

1.3 Information from Public and Third-Party Sources

We collect publicly available business information about venues — for example from venue websites, search engines, and public listings — including via our crawler, PinSpotBot (user agent: PinSpotBot/1.0), to create preliminary venue profiles and compute AI readiness scores. We may also receive information from integrated platforms (e.g., Google Business Profile, Meta platforms) when you connect them to your account.

2. How We Use Information

We use information to:

• provide, operate, and improve the Service, including hosting venue profiles and computing AI readiness scores;
• verify venue claims (including by SMS verification codes);
• operate the messaging update agent, including processing your messages with automated systems and AI providers to interpret and apply your requested updates;
• publish and distribute venue business data to the public and to third-party platforms and AI systems (this is the core purpose of the Service);
• process payments, manage subscriptions, and send billing notices;
• send service communications, and — with your consent — marketing communications;
• monitor, secure, and debug the Service, and prevent fraud and abuse; and
• comply with legal obligations.

3. SMS and Messaging Privacy

• We use your phone number to send verification codes, service/transactional messages related to your account and venue profile, and — only with your separate consent — marketing messages.
• Message content you exchange with the PinSpot agent is stored and processed to operate the Service, including processing by third-party AI providers acting as our service providers.
• No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except as necessary to deliver messages (e.g., our messaging providers) or as required by law.
• You can opt out of SMS at any time by replying STOP, or get help by replying HELP or emailing mike@13ten4.com.

4. How We Share Information

We share information with:

• Service providers who process data on our behalf, including: Stripe (payments), Supabase (database and authentication hosting), our SMS/WhatsApp messaging providers (e.g., Infobip), Klaviyo (email), AI providers (e.g., Anthropic, to power the messaging agent), analytics providers (e.g., Google Analytics), and hosting providers. These providers may use the data only to provide services to us.
• Third-party platforms and the public — venue business data is published on public profile pages and distributed to AI systems, search engines, and platforms (e.g., Google, Meta). This applies to venue business information, not your account credentials or private personal details.
• Connected platforms you authorize — if you connect Google Business Profile or Meta accounts, we exchange data with those platforms as needed to provide the integration.
• Legal and safety — where required by law, legal process, or to protect the rights, safety, or property of PinSpot, our users, or others.
• Business transfers — in connection with a merger, acquisition, financing, or sale of assets, in which case this policy will continue to apply to previously collected data.

We do not sell your personal information, and we do not share personal information with third parties for their own targeted advertising.

5. Data Retention

We retain personal information for as long as your account is active and as needed to provide the Service, comply with legal obligations (e.g., tax and payment records), resolve disputes, and enforce agreements. Message logs and verification records are retained for operational and compliance purposes and then deleted or anonymized. Venue business data may be retained and continue to be published as described in our Terms and Conditions, including after account closure.

6. Security

We use reasonable technical and organizational measures to protect personal information, including encryption in transit, access controls, and hosting with reputable infrastructure providers. No system is completely secure; we cannot guarantee absolute security. Notify us immediately at mike@13ten4.com if you suspect unauthorized access to your account.

7. Your Rights and Choices

Depending on where you live, you may have rights to:

• access the personal information we hold about you;
• correct inaccurate personal information;
• delete your personal information;
• port your data to another service; and
• opt out of marketing communications (via unsubscribe links or by replying STOP to texts).

To exercise these rights, email mike@13ten4.com. We will verify your identity before acting on a request and respond within the timeframes required by applicable law. We will not discriminate against you for exercising your rights.

State privacy laws (e.g., California, Colorado, Virginia and others). Residents of certain U.S. states have specific rights under state privacy laws, including the rights listed above and the right to opt out of "sales" or "sharing" of personal information. We do not sell personal information or share it for cross-context behavioral advertising. Authorized agents may submit requests on your behalf with proof of authorization. If we deny your request, you may appeal by replying to our decision email.

Note: personal-information rights apply to personal data, not to public business information about a venue (e.g., hours and events), which is governed by our Terms and Conditions.

8. Children

The Service is intended for business users aged 18 and over. We do not knowingly collect personal information from children under 13 (or under 16 where a higher age applies). If you believe a child has provided us personal information, contact mike@13ten4.com and we will delete it.

9. International Users

The Service is operated from the United States and information is processed and stored in the United States. If you access the Service from outside the U.S., you understand your information will be transferred to and processed in the U.S., which may have different data protection laws than your jurisdiction.

10. Third-Party Links and Services

The Service may link to third-party websites and services (including WhatsApp, Google, and Meta platforms). Their privacy practices are governed by their own policies, which we encourage you to review.

11. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email or through the Service before the changes take effect. The "Last Updated" date at the top shows the latest revision.
